Privacy Policy

1. Introduction.
Medland Orthodontics, (“MO”, “we”, “our”, “we”, or “us”) is dedicated to respecting the privacy rights of our Users and visitors to (the “Site”), and Services provided by MO through the Site (collectively, the “Services”). Our Privacy Policy was created to demonstrate our commitment to fair information practices and the protection of privacy, so as to give you confidence when you visit the Site and use the Services. This Privacy Policy is only applicable to our Site and information obtained by us from any of our business affiliates, and not to any other websites that you may be able to access from the Site or any website of MO’s business partners, each of which could have data collection, storage, and use practices and policies that differ from this Privacy Policy. Your use of the Services is ruled by this Privacy Policy and the Terms of Use. By using the Site and/or Services, and/or by registering as Users with us, you are agreeing to accept the polices and practices as detailed in this Privacy Policy, and you hereby consent to us tracking, collecting, using and sharing your information in the following ways. In the event that you are registering as a User, or are using the Services on behalf of an entity or individual other than yourself, you deem that you are authorised by such entity or individual to accept this Privacy Policy on such entity’s or individual’s behalf.
2. Traffic Data Collected.
We automatically track and collect the following categories of information when you visit our Site: (1) types of web browsers used to access the Site; (2) referring source which may have sent you to the Site; (3) types of computers accessing the Site; (4) IP addresses; (5) domain servers; and (6) other information associated with the interaction of your browser and the Site (collectively “Traffic Data”).
3. How MO Uses Your Information.
Use of the Services may require MO to use your Personal Information to allow your Providers to refer you to, and make appointments with, other Service Providers on your behalf. Your contact data may be used to send you information about MO or our Services or products, to contact you when necessary, including but not limited to, reminding you of upcoming or follow-up appointments, and in conjunction with your use of certain interactive tools. We may use your insurance data, demographic data, personal needs data or Traffic Data, to customise and tailor your experience through the Services, in other communications and in emails, displaying content according to your preferences and that which we think you might be interested in. We may use your Personal Information to recommend certain resources or Service Providers. We may also use your non-identifying Personal Information to perform (or authorise third parties to perform) statistical research on individual or aggregate service industry trends. Such research would only use your Personal Information in an anonymous manner that cannot be tied directly back to you.
4. Personal Information Collected.
We may require you to provide us with certain information that personally identifies you (“Personal Information”) in order for you to access some areas of the Site and/or certain Services when it is important for us to know more about you so that we can best meet your needs. Any information you provide in any communications you send to us for example, by e-mail or letter, may be collected as Personal Information. Personal Information includes the following types of information: (1) demographic data (such as your gender, your date of birth and your postcode); (2) contact data (such as your e-mail address and phone); and (3) service needs data (such as course of orthodontic treatment); and (4) your reason for visiting Service Providers, your date of visiting Service Providers, your service use history, and other information you choose to share with us.
5. Interactive and Installed Tools.
Some of the free Interactive Tools on our Site ask you for certain Personal Information. In order for you to use certain Services available through the Site you will need to download and install software on your computer (“Installed Tools”). These Installed Tools may collect and transmit information from your computer system relating to use of the Installed Tools and for the purpose of providing you the relevant Services, for example, by informing MO when a User is logged on and available to receive updates, or a message informing you of an upcoming appointment, or a change in appointment time (“Notification”). We also collect other information (some of which may be Personal Information) that you voluntarily provide to us when you choose to use some of the Site Services. Interactive tools on the Site and Services (“Interactive Tools”), such as searching for Service Providers, searching for available appointments with Service Providers, and completing forms on the Site (“Site Forms”) prior to Service Provider appointments. Information you provide voluntarily in free-form text boxes on the Site and through responses to surveys and feedback forms, questionnaires and the like are also collected.
6. Web Beacons.
In limited circumstances, we also may use small graphic image files embedded in an email or web page that provide a presence on the email or web page and send back to its originating server information from the User’s browser (“Web Beacons”) to collect anonymous, non-personal information about your use of our Services, the sites of selected sponsors and advertisers, and your use of emails, special promotions or other communications we send to you. Information collected by Web Beacons enable us to monitor how people are opening our emails, and for what purposes, or using the Services and selected sponsors’ and advertisers’ sites.
7. Cookies.
Cookies are computer files that are transferred to your computer’s hard drive that contain information such as User ID, User preferences, lists of pages visited, and activities conducted while browsing the Site to store some of your preferences and to help us improve our Site by tracking your navigation habits. Cookies do not allow our site to gain access to other information on your computer. You may choose at your expense and responsibility to block Cookies or delete Cookies from your hard drive. Beware that by disabling Cookies, you might not have access to the all the features of the Site. Additionally, our business partners may use Cookies to provide us with anonymous data and information regarding the use of our Services. Specifically, some of our business partners use Cookies to show MO ads on other sites on the internet as a result of you using the Services. These types of Cookies contain no Personal Information. You may opt out of receiving Cookies placed by these third party’s vendors. Other Cookies used by our business partners are likely to collect some non-personally identifying information, such as the geographic location of your internet service provider, the type of internet browsing software, the computer’s IP address, type of operating system, which web pages were visited and at what time, and some demographic information, such as age and gender. This information is used to provide MO with more information about our Users’ internet behaviour and demographics. We presently do not associate the information stored in these Cookies directly to any of your Personal Information you submit while on the Site.
8. Website Analytics.
We often use third party website analytics services in connection with the Services, for example, to record mouse movements, mouse clicks, scrolling activity, as well as any text that you type into the Site. These website analytics services do not collect Personal Information that you do not voluntarily enter into the Site. These services do not track your browsing habits across websites which do not use their services. The information collected from these services is used by us to find usability problems so we may to make the Services more user friendly. The recordings only record anonymous user information and they will never identify you or your account.
9. Storage.
Storage of all Traffic Data and reviewing of postings are done indefinitely; even after “deletion”, we may archive such information. All of your Personal Information is stored until you request that it be modified or deleted, and in such cases we may still retain certain Personal Information for the reasons described in Section 17 below.
10. Providing Information on Behalf of a Child.
It is the policy of MO to adhere to the provisions and spirit of the Children’s Online Privacy Protection Act (COPPA) and as such we do not collect information from children under the age of 13 as discussed below. As a parent or legal guardian of a minor child, you may, in compliance with the Terms of Use, use the Services on behalf of such minor child. Information that you provide us while using the Services on behalf of your minor child will be treated as Personal Information as otherwise provided herein.
11. Children’s Online Privacy Protection Act.
The Services are not aimed at children, and MO does not knowingly collect any information from individuals under the age of 13. COPPA severely restricts what information can be collected from children under the age of 13. For this reason, children under the age of 13 in the United States are prohibited from using the Services. If we become aware that we have received any information from an individual under the age of 13, we will use that information only to respond directly to that child (or a parent or legal guardian) to inform him or her that he or she cannot use the Services and subsequently we will delete that information from the servers we have control of.
12. Information Sharing.
Some categories of information we collect from you we share in the ways described in this Privacy Policy, including as described below:
For us to customise your advertising interactions, we are likely to share Personal Information with marketing stakeholders and other third parties only on an aggregate (i.e., anonymous) basis;
We may share your contact data with some of our stakeholders to enable them to send you MO promotional materials. These stakeholders will only use your contact data to send you MO promotional materials;
You may choose to authorise MO to share your Personal Information with selected Providers. For example, if you elect to complete a Smile Profile using the Services in advance of an appointment, we may share your Smile Profile with our Service Providers if you agree that we may do so;
We may share your contact data, Traffic Data, demographic data, and Service postcode data with Service Providers you choose to schedule through the Services;
We share Personal Information and Traffic Data with our business partners who assist us by performing core services (such as website hosting, billing, data storage and security) related to our operation of the Services and/or by making certain Interactive Tools available to our Users. These business partners shall be bound to uphold the same standards of security and confidentiality that we have promised to you in this Privacy Policy, and they have been contracted to only use your contact data and other Personal Information to carry out their specific business obligations to MO and to provide your requested services;
We may share your anonymous Personal Information with third parties to enable them to run statistical research on individual or aggregate service trends;
We may share certain marketing data including, but not limited to, anonymous Personal Information and non-Personal Information, with our business partners to help determine the effectiveness of certain advertising campaigns;
MO does not rent, share, sell, trade or barter your Personal Information with any third parties for their promotional purposes;
In the event that we sell the MO business to another party, or as a result of merge or acquisition by MO, we may transfer information about you to another company in connection with such changes. In this event, we will use all reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.
13. User Choice.
You can choose not to provide us with any identifying Personal Information. However, in such an event, you will only be able to access a limited number of our Services and you will not be able to access and use certain key features of the Services that require your Personal Information.
14. Security.
We practice usually accepted industry standards to protect the Personal Information you submit to us, both during transmission and once we receive it. For example, we encrypt information you submit to us using secure socket layer technology (“SSL”) when you enter sensitive information on our Site. You must understand that there is no such thing as 100% information security, and we do not guarantee that there will be no unintended disclosures of your Personal Information. However, we make good faith efforts to store your Personal Information in a secure digital environment that is not open to the public. If and when we become aware that Personal Information you have submitted has been disclosed in a manner which is not in accordance with this Privacy Policy, we will undertake reasonable efforts to make you aware of the extent and nature of the disclosure (to the extent to which we know that information) as soon as reasonably practicable and as permitted by governing law.
15. Security and Confidentiality.
We will make every effort to keep your Personal Information private and will not share it with third parties, except as provided in this Privacy Policy, unless we believe in good faith that disclosure of your Personal Information or any other information we collect about you is necessary to: (1) respond to claims that any posting or other content violates the rights of third-parties; (2) comply with a legal process or court orders; (3) protect the rights, property or safety of MO or another party; or (4) enforce our Terms of Use.
16. Public Information.
You should think carefully before disclosing any personally identifiable information in any public forum because any information that you will reveal in a review posting or other online discussion or forum is intentionally open to the public and is not in any way private. What you write is highly likely to be collected and/or seen by third parties and may be used by others in ways we are unable to predict or control.
17. Providers of Regulated Healthcare Services.
Providers of regulated healthcare services, their staff, and their agents should be particularly aware of their obligations of patient confidentiality, including without limitation their obligations under any Act and or Regulations applicable to the practice of their profession or service, both in communicating with MO and in responding to a review of their services posted on our Site. MO does not have, and will not accept, any obligations of confidentiality with respect to any communications other than those expressly stated in this Privacy Policy and MO’s Terms of Use.
18. Our Management of Your Personal Information.
As a registered User of the Services, you can modify some of the Personal Information you have included in your profile or change your Username by logging in and accessing your account. If, at any time you wish to close your account, you should email: Upon your request, MO will use commercially reasonable efforts to delete your account and the Personal Information in your profile; however, it may be impossible to remove your account without some residual information being retained by MO. MO has no obligation to delete any data or information you provide on a Smile Profile following termination of your account or the account of any Service Provider to whom your Service Address Form was submitted through the Services.
19. Stolen or Lost Information.
If your contact data is lost, stolen, or used without permission, you must promptly notify us. In such an event, we will remove that contact data from your account and update our records accordingly.
20. Links to Other Websites.
This Privacy Policy only covers our Site; some websites may have a similar look and feel to our Site, so please be aware that you may be on a different site. The Site may contain links to third party websites to which MO has no affiliation and since MO does not share your Personal Information with those websites, we are not responsible for their privacy practices. A link to a non-MO website does not imply or constitute endorsement by MO. Furthermore, we cannot guarantee the quality or accuracy of information presented on non-MO websites. Should you decide to visit one of these third party websites, we suggest that you read its privacy policy.
21. Updates to Privacy Policy.
In every case, use of information we collect is subject to the Privacy Policy in effect at the time such information is collected. We recommend you review the Privacy Policy frequently as we reserve the right, at any time, to change, add to, modify or update this Privacy Policy. If we do update the Privacy Policy, we will post the amended Privacy Policy on the Site; and may also endeavour to notify you in some other way.
